1.THE AGREEMENT

These Terms of Service ("Terms") are a legal agreement between you and FinShark ("FinShark", "we", "us"), the maker of TallyMap. They cover the TallyMap iPhone app, its widgets, and the website at tallymap.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

In plain words TallyMap is a spending-visualization and habit game. It reads your transactions (never moves money), draws them on a map, and lets you dare friends. Use it honestly, don't break it, and understand that the map is a picture of your bank's data, not a financial statement.

2.WHO CAN USE TALLYMAP

You must be at least 13 years old to use the Service. If you are under 18, you may use TallyMap only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. You may only connect financial accounts that you own or are authorized to access. The Service is currently offered for banks and cards in the United States. You may not use the Service if you are barred from doing so under applicable law.

3.YOUR ACCOUNT

You sign in with your Apple ID through Sign in with Apple. You are responsible for keeping your Apple ID and your device secure and for everything that happens under your account. Tell us at hello@tallymap.app if you think your account has been used without your permission. One account per person; don't share it or use someone else's.

4.BANK CONNECTIONS

To show real spending, TallyMap connects to your bank or card through Plaid Inc. When you link an account you authorize Plaid to retrieve your transaction data from your financial institution and deliver it to TallyMap, and you agree to Plaid's End User Services Agreement and End User Privacy Policy.

  • The connection is read-only. TallyMap cannot initiate payments, transfers, or any other transaction, and cannot change anything at your bank.
  • Your bank login credentials are entered directly with Plaid and are never stored by FinShark.
  • You can disconnect a bank in the app at any time, or revoke TallyMap's access at my.plaid.com.
  • You may only connect accounts you are entitled to access. Connecting someone else's account without authorization is a breach of these Terms and may be illegal.
  • Banks and Plaid sometimes change, throttle, or break connections. We'll do our best to keep things syncing, but we can't guarantee any particular bank will work or stay working.

5.NOT FINANCIAL ADVICE

TallyMap shows you where your money went and encourages you to spend less at spots you choose. It is not a bank, a budgeting fiduciary, a financial, investment, tax, or legal adviser, or a substitute for your bank's own records. Nothing in the Service, including strokes, streaks, stickers, digests, nudges, and dare outcomes, is advice about what you should do with your money. Decisions you make based on the Service are yours.

6.ACCURACY OF THE MAP

The map is built from data your bank sends through Plaid, then interpreted by our place-resolution engine. That means:

  • Transactions may appear with a delay of hours or days, and pending transactions may change or disappear.
  • Merchant names, categories, and especially locations can be wrong or missing. A stroke may land on the wrong branch of a chain, on a merchant's headquarters, or in the "online & unmapped" bucket. You can flag a transaction as "not me" or reclassify it, but the underlying data comes from your bank.
  • Totals, streaks, stickers, and leaderboards are computed from that data and inherit its errors.

Always rely on your bank's official statements for balances, disputes, and anything that matters legally or financially.

7.FRIENDS, DARES & CONDUCT

When friend features are available, you can add friends, compare tallies, and dare each other to skip a spot for a period. Friends see counts, streaks, stickers, the spot a dare is about, and the messages you send them; they never see your amounts or transaction list (see the Privacy Policy).

Dares are for fun. "Loser buys" is a joke between friends, not a contract we create, enforce, or take part in. We do not handle any money, bets, or prizes between users, and we won't referee who owes whom a coffee.

While using the Service you agree not to:

  • harass, threaten, or abuse other users, or send content that is hateful, sexually explicit, or illegal;
  • impersonate anyone, misrepresent your identity, or create accounts for others;
  • use the Service for gambling, wagering for money, or anything that would require a license;
  • reverse engineer, scrape, probe, or interfere with the Service, our backend, or Plaid's systems, or try to access data that isn't yours;
  • use bots, automation, or fake transactions to game streaks, stickers, or leaderboards;
  • use the Service to break any law or anyone's rights.

We may remove content and suspend or terminate accounts that break these rules.

8.SUBSCRIPTIONS

TallyMap is free to use. We may offer an optional paid tier (for example, additional bank connections, full history, or extra features) as an auto-renewing subscription purchased through Apple's App Store. If we do, the price, billing period, and what's included will be shown in the app before you buy.

  • Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
  • You manage and cancel subscriptions in your Apple ID settings, not in the app. Deleting the app does not cancel a subscription.
  • Refunds are handled by Apple under App Store policies; we cannot issue them directly.
  • Any free trial converts to a paid subscription unless cancelled before the trial ends.
  • We may change subscription prices or features with notice; changes apply from your next renewal after the notice.

9.LICENSE & OWNERSHIP

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the TallyMap app on Apple devices you own or control, as permitted by the App Store terms, for your own non-commercial use. The Service, including the app, its design, the tally and sticker artwork, the mascot, the name TallyMap, and the place-resolution engine, belongs to FinShark or its licensors and is protected by copyright, trademark, and other laws. These Terms don't give you any right to use our names, logos, or artwork.

Your data stays yours. You own your transaction data and anything you create in the app. You give us only the limited permission we need to operate the Service for you as described in the Privacy Policy, including showing your counts and messages to the friends you choose. Brag sheets and screenshots you export are yours to share.

If you send us feedback or ideas, we can use them without owing you anything.

10.PRIVACY

Our Privacy Policy explains what we collect, where it lives, and how to delete it. It is part of these Terms. The short version: read-only bank link, transactions stored on your phone, no GPS, no ads, no data sales, and one-tap account deletion.

11.ENDING THINGS

You can stop using TallyMap at any time. Deleting your account in the app permanently removes your account and bank connections from our backend, revokes access at Plaid, and wipes the app's data from your device.

We may suspend or terminate your access if you breach these Terms, if required by law, if a provider such as Plaid or Apple requires it, or if we discontinue the Service. If we discontinue TallyMap, we'll give reasonable notice where possible and any paid subscription will be handled under Apple's refund policies. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnity, governing law) survive termination.

12.DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FINSHARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, TIMELY, UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY PARTICULAR BANK WILL CONNECT OR STAY CONNECTED, OR THAT TRANSACTION LOCATIONS, CATEGORIES, TOTALS, OR STREAKS WILL BE CORRECT. Some jurisdictions don't allow certain disclaimers, so some of the above may not apply to you.

13.LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FINSHARK AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, HOWEVER CAUSED, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US$50). These limits don't apply to liability that can't be limited by law, including for gross negligence, willful misconduct, or fraud.

14.INDEMNITY

You agree to defend and hold harmless FinShark from claims, damages, and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Service, your connection of accounts you were not authorized to access, or content you send to other users.

15.GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by applicable US federal law.

Talk to us first. If you have a dispute with us, email hello@tallymap.app with a description of the problem and what you'd like us to do. We'll try to resolve it informally within 30 days. Most things can be fixed this way.

If we can't resolve it informally, any claim relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small-claims court where permitted. To the extent allowed by law, you and we each waive any right to a jury trial and agree that claims will be brought only on an individual basis, not as a plaintiff or class member in any class or representative action. You must bring any claim within one year after it arises, or it is permanently barred.

16.APPLE

The app is distributed through Apple's App Store, so a few additional terms apply. These Terms are between you and FinShark only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, or consumer-protection claims. If a third party claims that the app infringes its intellectual property rights, FinShark, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim. You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country and are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with any applicable third-party terms (for example, your wireless carrier's) when using the app.

17.EVERYTHING ELSE

Changes. We may update these Terms as the Service evolves. We'll post the new version here with a new effective date and, for material changes, tell you in the app before they take effect. Using the Service after that means you accept the changes. If you don't, stop using the Service and delete your account.

Beta features. Some features (including TestFlight builds and features labelled "coming soon" or "beta") may be experimental, change without notice, or be removed. They are provided as-is.

Whole agreement. These Terms and the Privacy Policy are the entire agreement between you and FinShark about the Service. If any part is unenforceable, the rest still applies. Our not enforcing a provision isn't a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Service, and will notify you if we do. Nothing here creates a partnership, employment, or agency relationship.
